The laws are not clear. Ther are the Mass general Laws The act of 1950 and Executive Orders. The position of Emergency Manager is mandated by the state for each County and Town in the Commonwealth. The County Emergency Manager is appointed by the County Commissioners and the town Emergency Managers are appointed by the Selectmen of each town. At present, the role and responsibilities of the Island Emergency Managers are governed by Mass General Laws, Executive Orders, and the 55 year old “Act of 1950”. And these laws are not clear, especially to town leaders. The Emergency Management position is treated by municipalities only on an as needed basis and get attention only when an incident occurs (Spare Tire Syndrome). However, most of the Emergency Managers in small communities are being tasked with larger and larger tasks and responsibilities by the Federal and State governments while the position, at the Municipal level is being treated as volunteer, and is usually minimally funded. The Emergency Management Director’s position is usually unpaid. Which is probably why most town Emergency Managers that meet at the regional Emergency Management meetings at MEMA appear to be between the ages of 55 and 65. As for the tasks and responsibilities, there are the traditional hurricanes and winter storms, Hazardous Materials, and the like, but now Emergency Managers have to deal with the non-traditional threats such as Homeland Security issues like Maritime Security, Anthrax, foreign and domestic terrorism and Public Health issues such as Avian Flu. The expected roles and responsibilities for Emergency Managers have become much more professional in nature and it appears that the Federal and State governments now expect that the Emergency Manager will act as an incident information coordinator between involved departments and between the state and the town. These new threats require an Emergency Management presence during the incident but because this position is treated as an “as needed” service at the Municipal level, other agencies do not consider them to be partners and thus the Federal and State expectations are not being met. If the Federal and State Governments want the Emergency Manager to be able to fulfill these new responsibilities that are being required of them by the Federal and State Governments, then the state is going to have to change the present perception of the Emergency Managers Roles, Responsibility and Authority among the appointing officials, and the Incident Responders. What can the Office of Congressman Delehunt do to solve this problem? Introduce legislation that would empower Emergency Managers at the local level Update and define the rules and laws governing the role and responsibilities of the local Emergency Manager Mandate minimum training and accreditation for the position of a local Emergency Manager Publicize the role of the local Emergency Manager What can the Office of Congressman Delehunt do for the Island Emergency Management Structure. The County Emergency M anager suggest that The County Emergency Manager occupies a rather unique role among the Emergency Managers of Martha’s Vineyard. He is the current, acting chairperson of the Dukes County Emergency Management Directors Association, which is comprised of 5 of the 6 towns. He is the primary point of contact between the state and the participating Emergency Managers for informational matters. Operational matters are handled by the individual town Emergency Managers. He is the Dukes County HAN administrator, which is the State’s preferred method of informing and alerting responders during heath and other crises He hold a Maritime Security Company security Officer Ceertificate from Mass Maritime (2005) e He hHHHHe has worked for both FEMA and MEMA as liaison to the former Regional Director of FEMA and the former Operations Manager at MEMA headquarters in Framingham.
