Greetings:

In the name of the Commonwealth of Massachusetts you are hereby directed to notify the inhabitants of the Town of Tisbury who are qualified to vote in elections to assemble at the General George W. Goethals American Legion Post #257 at 47 Martin Road, Vineyard Haven, in said Town of Tisbury, on the eighth day of May in the year Two Thousand and One between the hours of twelve noon and eight o’clock in the evening, then and there to give their votes, under the system as adopted by the Town, viz.:

ARTICLE 1 TO PAY BILLS OF PRIOR YEARS - FISCAL YEAR 2001

To see if the Town will vote to appropriate and transfer from Unreserved Fund Balance a sum of money to be expended by the departments listed below in fiscal year 2001 for the payment of bills incurred in the prior fiscal year, or take any action relative thereto.

ARTICLE 2 FISCAL YEAR 2002 OPERATING BUDGET

To see if the Town will vote to raise and appropriate the sum of Fourteen Million Three Hundred Ten Thousand Seven Hundred Fourteen Dollars ($14,310,714) to defray Town charges as set out in Appendix A of this warrant for the fiscal year July 1, 2001 through June 30, 2002 (FY2002), or take any action relative thereto.

ARTICLE 3 CAPITAL APPROPRIATIONS AND OTHER NEW EQUIPMENT

To see if the Town will vote to raise and appropriate, transfer from available funds, or authorize the Treasurer with the approval of the Board of Selectmen to borrow under chapter 44, section 7 or 8, or section 21A, or any other enabling legislation, the sums of money listed below, to be expended by the indicated Departments for the purposes listed and deemed to be capital expenditures:

a) To raise and appropriate, borrow, or transfer from available funds the sum of Five Thousand Dollars ($5,000) as the Town of Tisbury’s share of the costs related to construction of a skate-board park to be located on property managed by the Martha’s Vineyard Arena, and to authorize the Board of Selectmen to enter into an Inter-Municipal Agreement with the County of Dukes County and at least four (4) of the other Towns on Martha’s Vineyard to share in the construction costs of such a skate park.

b) To raise and appropriate, borrow or transfer from available funds the sum of One Hundred Thousand Dollars ($100,000) for the School Department to implement Phase II of the upgrade of the Tisbury School heating system, including the ability to control the heat with thermostats in individual classrooms and installing air conditioning in the two computer labs and the technician’s office, or take any action relative thereto.

c) To raise and appropriate, borrow or transfer from available funds the sum of Thirty Five Thousand Dollars ($35,000), for the School Department to repair the concrete crumbling sign on the façade of the Tisbury School Building.

d) To raise and appropriate, borrow or transfer from available funds the sum of Twenty Thousand Dollars ($20,000), for the Council on Aging to replace the kitchen flooring, cabinets, countertops and cabinets, and to refinish walls and ceilings in the Senior Center, or take any action relative thereto.

e) To raise and appropriate, borrow or transfer from Unreserved Fund Balance the sum of Eighty Thousand Dollars ($80,000) for the Harbormaster to dredge the Lake Tashmoo Entrance Channel in FY2001, or take any action relative thereto.

f) To transfer from the Waterways Fund the sum of Two Thousand Dollars ($2,000) for the Harbormaster to purchase Outer Harbor Speed Buoys, or take any action relative thereto.

g) To transfer from the Waterways Fund the sum of Two Thousand Dollars ($2,000) for the Harbormaster to make improvements to the Owen Park Dinghy Dock, or take any action relative thereto.

h) To transfer from the Waterways Fund the sum of Two Thousand Dollars ($2,000) for the Harbormaster to build a Dinghy Dock and Storage Racks at Lake Tashmoo, or take any action relative thereto.

i) To transfer from the Waterways Fund the sum of Six Thousand Dollars ($6,000) for the Harbormaster to Make Improvements to the Owen Park Pier, or take any action relative thereto.

j) To transfer from the Waterways Fund the sum of Five Thousand Dollars ($5,000) for the Harbormaster to develop a comprehensive dredge plan, or take any action relative thereto.

k) To transfer from the Waterways Fund the sum of Seven Thousand Dollars ($7,000) for the Harbormaster to purchase a new outboard motor for the Harbormaster’s Tashmoo 15 boat, or take any action relative thereto.

l) To raise and appropriate, borrow, or transfer from available funds the sum of Sixty Thousand Dollars ($60,000) for the Department of Public Works to replace an existing 1989 6-yard garbage truck and all necessary peripheral equipment, or take any action relative thereto.

m) To raise and appropriate, borrow, or transfer from available funds the sum of Twenty Five Thousand Dollars ($25,000) for the Department of Public Works to replace an existing 1985 pick-up truck and all necessary peripheral equipment, or take any action relative thereto.

n) To raise and appropriate, borrow, or transfer from available funds the sum of Twenty Five Thousand Dollars ($25,000) for the Department of Public Works to construct concrete sidewalks along existing public, Town ways, or take any action relative thereto.

o) To raise and appropriate, borrow, transfer from available funds or accept as a grant the sum of Eighty-five Thousand Dollars ($85,000) for the Department of Public Works to replace an existing 1990 6-cell recycling truck and all necessary peripheral equipment, or take any action relative thereto.

p) To raise and appropriate, borrow, or transfer from available funds the sum of Five Thousand Dollars ($5,000) for the Board of Selectmen to replace the boiler at the Town’s downtown Public Rest Rooms, or take any action relative thereto.

q) To raise and appropriate, borrow, or transfer from available funds the sum of Twenty Nine Thousand Nine Hundred Dollars ($29,900) for the Police Department to purchase and equip one new police cruiser, or take any action relative thereto.

ARTICLE 4 TO FUND MEMBERSHIP IN THE CAPE LIGHT COMPACT

To see if the Town will vote to raise and appropriate, transfer from available funds, or borrow the sum of Six Thousand Seven Hundred Twenty Dollars ($6,720) for the purpose of funding the town’s continued participation in the Cape Light Compact during Fiscal Year 2002, or take any action relative thereto.

ARTICLE 5 TO TRANSFER FROM UNRESERVED FUND BALANCE TO REDUCE THE TAX RATE

To see if the Town will vote to appropriate and transfer the sum of Nine Hundred Thousand Dollars ($900,000) from Unreserved Fund Balance to meet the limitations of Chapter 59 of the General Laws (Proposition Two and One Half, so called), as amended, or to reduce the tax rate; or take any action relative thereto.

ARTICLE 6 TO TRANSFER RESERVE FOR APPROPRIATION TO REFUSE OPERATIONS

To see if the Town will vote to appropriate and transfer the sum of One Hundred and Seventy Five Thousand Dollars ($175,000) to refuse, recycling and local drop off operations for fiscal year 2002 from the reserve for appropriation for sanitary landfill as provided for in Article 19 of the Special Town Meeting of November 2, 1993, or take any action relative thereto.

ARTICLE 7 TO TRANSFER RESERVE FOR APPROPRIATION TO REFUSE OPERATIONS

To see if the Town will vote to appropriate and transfer the sum of Fifty Five Thousand Dollars ($55,000) to refuse, recycling and local drop off operations for fiscal year 2001 from the reserve for appropriation for sanitary landfill as provided for in Article 19 of the Special Town Meeting of November 2, 1993, or take any action relative thereto.

ARTICLE 8 TO HIRE, TRAIN, AND EQUIP POLICE OFFICERS TO FILL VACANCIES

To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Four Thousand Dollars ($4,000) to hire, equip and train police officers for the Tisbury Police Department.

ARTICLE 9 TO PROVIDE MATCHING FUNDS FOR ISLAND-WIDE DRUG GRANT

To see if the Town will vote to raise and appropriate or transfer from available funds the sum of Two Thousand Five Hundred Dollars ($2,500) as the Town’s matching fund portion of the Island wide drug enforcement grant.

ARTICLE 10 TO ACCEPT REIMBURSEMENT FROM THE S.S.A.

To see if the Town will vote to accept the sum of Thirty Two Thousand Five Hundred Dollars ($32,500), or some other sum of money, from the Wood’s Hole, Martha’s Vineyard and Nantucket Steamship Authority as reimbursement for police services to be performed covering summer traffic in the vicinity of the S.S.A. terminal in Vineyard Haven or any other location during the fiscal year 2002, or take any action relative thereto.

ARTICLE 11 TO ADOPT THE COMMUNITY PRESERVATION ACT

To see if the Town will vote to accept General Laws Chapter 44, Sections 3-7, known as the Community Preservation Act, which establishes a Special "Community Preservation Fund" that may be appropriated and spent for certain open space, historic resources and affordable housing purposes; to approve a property tax surcharge in an amount not to exceed three percent of the taxes assessed annually on real property, which shall be dedicated to the fund, such surcharge to be imposed on taxes assessed for fiscal years beginning on or after July 1, 2002, and to exempt from the surcharge any or all of the following (1) property owned and occupied as a domicile by a person who would qualify for low income housing or low or moderate income senior housing in the community; (2) Class Three, Commercial and Class Four, Industrial, property in any year the town adopts a higher tax rate for those classes and ; or (3) $100,000 of the assessed valuation of Class One, residential, real property, or take any other action relative thereto.

ARTICLE 12 ADDITIONAL REGIONAL HIGH SCHOOL CH. 70 FUNDS FOR FY2001

To see if the Town will vote to allow Martha’s Vineyard Regional High School to appropriate the sum of Seven Hundred and Fifty Thousand Dollars ($750,000) from FY2001 Chapter 70 Funds, so-called, to fund and pay Martha’s Vineyard Regional High School Expenses for the remainder of the fiscal year ending June 30, 2001.

ARTICLE 13 TO RESCIND BORROWING FOR STORM WATER MANAGEMENT PROGRAM

To see if the Town will vote to rescind the borrowing authorization in the amount of Two Hundred Seventy Thousand Dollars ($270,000), to develop a storm water management program, voted under Article 3(a) at the Annual Town Meeting of April 25, 2000, or take any action relative thereto.

article 14 to Create a new position of lieutenant in the police department

ARTICLE 14 TO CREATE A NEW POSITION OF LIEUTENANT IN THE POLICE DEPARTMENT

To see if the Town will vote to establish a new permanent full time position of Lieutenant for the Police Department, funding for such position for Fiscal year 2002 to be provided from the personnel line item in the Fiscal Year 2002 Police Department budget from funds previously designated for a patrolman and a sergeant position; and to amend the Town’s Managerial and Professional Employee Classification and Salary Plan to include the Lieutenant’s position as M8, or take any action relative thereto.

ARTICLE 15 TO CREATE A NEW POSITION OF ASSISTANT HEALTH AGENT/FOOD INSPECTOR IN THE HEALTH DEPARTMENT

To see if the Town will vote to raise and appropriate Forty Thousand Dollars ($40,000) to establish a new permanent position of Assistant Health Agent/Food Inspector for the Health Department, or take any action relative thereto.

ARTICLE 16 TO AUTHORIZE A REVOLVING FUND FOR MEDICAID REIMBURSEMENTS FOR THE TISBURY SCHOOL COMMITTEE

To see if the Town will vote to direct, in accordance with Chapter 44, Section 53E ½ of the Massachusetts General Laws, that the reimbursements received for Medicaid reimbursed services be credited to a departmental revolving fund of the Tisbury School Committee, not to exceed Ten Thousand Dollars ($10,000), to be used to defray the costs of processing fees incurred in the application for reimbursement process and to defray unexpected special education costs, or take any action relative thereto., or take any other action relative thereto.

ARTICLE 17 TO AMEND INTERMUNICIPAL AGREEMENT FOR EMERGENCY SERVICES

To see if the Town will vote to amend the vote under Article 6 of the April 11, 2000 Special Town Meeting which authorized the Board of Selectmen to enter into an inter-municipal agreement with the County of Dukes County and at least four (4) of the other towns on the Island of Martha’s Vineyard (the "Island"), for the procurement of emergency medical services to be provided on the Island on a year-round, 24 hour-per-day, seven day-a-week basis, as voted at the April 11, 2000 Special Town Meeting, by adding the phrase "and FY2002" after "FY2001" in clause (iii), or take any action relative thereto.

ARTICLE 18 TO FUND INTER-MUNICIPAL AGREEMENT FOR EMERGENCY SERVICES

To see if the Town will vote to raise and appropriate a sum not to exceed Seventy-four Thousand Seven Hundred and Seventeen Dollars and Sixty-four Cents ($74,717.64) to fund Tisbury’s anticipated Fiscal Year 2002 share of the costs under the Inter-municipal Agreement providing for common procurement of emergency medical services, subject to the terms of the Agreement, or take any action relative thereto.
